Streetie Terms and Conditions

1. Introduction
Welcome to Streetie. These Terms and Conditions ("Terms") govern your use of the Streetie mobile application ("App"), owned and operated by Ben Turley ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

3. User Responsibilities
3.1 Compliance with Laws
You are responsible for ensuring that your use of the App complies with all applicable local, state, national, and international laws and regulations, including but not limited to laws regarding trespassing.
3.2 Accuracy of Information
You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4. App Functionality and Safety Disclaimer
The App uses public data to route users around high-crime areas and through more scenic areas based on user-determined thresholds. While we strive to provide safer navigation experiences, we cannot guarantee that the routes suggested will always ensure your safety. By using the App, you acknowledge and accept this limitation.
5. Payment Terms
5.1 Payment Processing
Payments for Streetie Star subscriptions are processed through the native systems of the Google Play Store and Apple App Store. Their respective policies apply to all transactions.
5.2 Subscription Plans
Streetie offers monthly and yearly subscription plans for Streetie Star, which unlock additional features, including but not limited to:
Filtering by crime type or specific scenery
Driving mode
Filtering areas with high car crash density
Live Crime Map displaying recent crimes in the city
5.3 Refunds and Cancellations
Refunds and cancellations are subject to the policies of the Google Play Store and Apple App Store.
6. Data Handling and Intellectual Property
6.1 Data Collection and Use
The App records route selections, route filter selections, and identifying information through the OAuth sign-in and profile system. Basic payment data is collected through the purchase process. We implement industry-standard security measures to protect your data, but we cannot guarantee absolute security.
6.2 Intellectual Property Rights
Streetie reserves the rights to any images, videos, and other generated content (such as routing results) as well as all the metadata used to run the algorithms. You acknowledge that all intellectual property rights in the App and the content are owned by us or our licensors.
6.3 Privacy Policy
Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and disclose information about you.
7. User Conduct
7.1 Prohibited Activities
You agree not to engage in any of the following prohibited activities:
Using the App for any illegal purpose
Copying, modifying, or distributing the App or its content without our prior written consent
Interfering with or disrupting the operation of the App
Attempting to gain unauthorized access to the App or its related systems
7.2 Consequences of Violations
We reserve the right to suspend or terminate your access to the App if you violate these Terms or engage in any prohibited activities.
8. Liability and Disclaimers
8.1 Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
Your use or inability to use the App
Any unauthorized access to or use of our servers and/or any personal information stored therein
Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party
8.2 Disclaimers of Warranties
The App is provided on an "as is" and "as available" basis. We disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Third-Party Services
9.1 Third-Party Integrations
The App uses third-party services including Google Maps as the basemap, Google Analytics for usage analysis, and Graphhopper for routing services. Your use of these services is subject to their respective terms and conditions.
9.2 Links to Third-Party Websites
The App may contain links to third-party websites. We are not responsible for the content or privacy practices of these websites.
10. Age Restrictions
You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent or guardian's permission to use the App.
11. Availability and Interruptions
We strive to keep the App operational at all times, but we do not guarantee continuous, uninterrupted access. The App may be unavailable from time to time for maintenance or other reasons.
12. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.
13. Feedback and Suggestions
If you provide any feedback or suggestions about the App, you hereby grant us an unlimited, irrevocable, perpetual, sublicensable, transferable, royalty-free license to use such feedback or suggestions for any purpose without compensation to you.
14. Export Control
You may not use, export, or re-export the App in violation of any applicable laws or regulations, including without limitation United States export laws and regulations.
15. Force Majeure
We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
16. Modification of Terms
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the App after any changes indicates your acceptance of the new Terms. It is your responsibility to review the Terms periodically for any updates or changes.
17. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Ben Turley operates, without regard to its conflict of law provisions.
18. Dispute Resolution
18.1 Informal Resolution
We encourage you to contact us at ben@streetie.app to resolve any disputes informally before pursuing any formal action.
18.2 Arbitration
Any disputes arising out of or relating to these Terms or the App will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in the jurisdiction where Ben Turley operates.
18.3 Class Action Waiver
You agree that any arbitration or legal action shall be conducted only on an individual basis and not in a class, consolidated, or representative action.
18.4 Forum Selection
If the arbitration clause is found to be unenforceable or does not apply, you agree that any legal action or proceeding related to these Terms shall be brought exclusively in the courts located in the jurisdiction where Ben Turley operates.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
20. Entire Agreement
These Terms constitute the entire agreement between you and Ben Turley regarding the use of the App and supersede any prior agreements or understandings, whether written or oral, relating to such subject matter.
